In order to protect your business idea, you should either:

  • apply for a patent for a central part of your product
  • trademark your product brand, company name, etc
  • register your copyright
  • or keep a the essential information as a trade secret

So for the purposes of this exercise, you need to determine which of these you will choose.  However, if you choose the first three, you need to register them.  Copy the following application and fill it in as a comment to this post.

    The phrase ”Wedding Voyage” is a too commonly used term within the travel industry and as such cannot often not be trademarked. If you would like to trademark it, you need to make it more unique. So your application for a trademark is not approved.

    However, something tells me that you wanted to get your business idea approved instead of applying for a trademark.

    EarthRace as a trademark for an MMO game is granted. However, I would like to point out that it is also being used in other industries (see for ex. http://www.earthrace.net/).

    As for the copyright application, you may copyright the background story etc for the game, but as such games are not covered by copyright. So you application for copyright of the game is declined.

    As for the patent, you may have a patent for the special lining but not for the entire product since it could be said that other products have done this in the past.

    Also, I need to mention that trademarking a name does not prevent development of similar products. It is the patent which protects your invention. Trademark simply reserves the rights for a certain name to be used by only one company.

    I think that you’re going to have to make an argument as to why CC would hold here when Copyright would not. I’m reading into this thinking that you would like to freely distribute your game, but that isn’t necessarily the same thing as protecting it. I still think you have to be more specific as to what parts you are CC:ing.

    Ok so to be more clear, we do not wish to protect the entire game including idea etc. with CC. What we wish for instead is a CC SA BY license to the code of the game. The argument for this is to involve users in contributing with the game code similar to how users of Wikipedia are involved in developing that site with material. We believe that a lot of budget savings can be done as we can cut down on coding ourselves and spend more time on checking the code that users contribute with. This license also improves our possibility to integrate Wikipedia to our site, which is very beneficial for the structure of the game.
